Late Tuesday afternoon Fox News reporter Rachel Sutherland repeatedly questioned White House press secretary Jen Psaki about the ‘message’ President Biden was sending when he signed his executive order regarding transgender rights. It wasn’t so much a question as it was an opportunity for Fox News listeners to hear their favorite trigger words cisgender, transgender, girls, and sports in the same sentence repeatedly said on national television.

“Trans Rights Are Human Rights,” said press secretary Jen Psaki. “That’s why he signed the executive order. In terms of the determinations by university and colleges, I would certainly defer to them.”

The order states, “Children should be able to learn without worrying about whether they will be denied access to the restroom, the locker room, or school sports.” The order also calls for protection against discrimination based on gender identity or sexual orientation.

However, the order does not explicitly address transgender women in sports. Its main clause could be challenged in numerous states where bills are being pushed that restrict the participation of transgender students in athletics.

Tennessee lawmakers on Tuesday advanced legislation that would prohibit transgender girls from playing on middle and high school sports teams as opponents warned the proposal will almost certainly face costly legal challenges if it’s signed into law.
The bill is still in the early stages in the GOP-dominant Statehouse, with multiple hearings in both chambers still required before it could land on Gov. Bill Lee’s desk. However, Republican House members expressed enthusiastic support for the proposal during Tuesday’s initial hearing — making Tennessee among the dozen of states with lawmakers are backing restrictions on athletics or gender-confirming health care for trans minors this year, reports News Observer
“We are the great state of Tennessee. We don’t operate like California or New York,” said Rep. Michelle Carringer, a Republican from Knoxville.
Currently, a similar 2020 Idaho law has been blocked by a federal judge as a lawsuit makes its way in court.
Some of the sports bills seek to ban transgender people from sports using DNA or genetic tests to verify the participant’s sex. Some seek to use the Birth certificate method. But they all share a common fatal flaw, they are costly mistakes. They have already been proven unconstitutional regardless of the verification process by the Supreme Court of the United States and numerous lower courts.
